Terms & Conditions
The terms that apply when you use this website or book any of our services.
Last updated: 2 November 2026
1. About us and these terms
These Terms & Conditions ("Terms") apply between Hydrokinetic Therapy ("we", "us", "our") and anyone who visits this website or books or receives our services ("you", "client"). We provide therapeutic and sports massage, physical therapy and rehabilitation, hydrotherapy, fitness training, swimming pool maintenance, swimming coaching and lifeguard and event safety services in and around Nairobi, Kenya.
By booking a service, filling in our New Client Form or using our services, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not book or use our services.
2. Bookings
- A booking made through this website, by phone or on WhatsApp is a request. It is only confirmed once we confirm the date, time, location and price with you.
- You must give us accurate contact details and an accurate location. We may decline or reschedule a booking if the location is unsafe, inaccessible or outside the areas we serve.
- Times are approximate for mobile services because of Nairobi traffic. We will tell you as early as possible if we are running late.
- We may refuse or stop a service at any time if we believe it is unsafe to continue, if you are under the influence of alcohol or drugs, or if you or anyone present behaves in an abusive, threatening or inappropriate way. In that case the full price may still be charged.
3. Cancellations and rescheduling
- Please give us at least 24 hours' notice to cancel or reschedule a session, pool visit or event booking, by phone or WhatsApp on 0716368914.
- We do not charge a cancellation fee. However, if you repeatedly cancel late or do not show up, we may ask you to pay in advance for future bookings or decline further bookings.
- If we need to cancel or reschedule (for example because of illness, unsafe weather for outdoor or pool work, or circumstances outside our control), we will tell you as soon as possible and offer another time. If you have paid in advance for a service we cannot provide, we will refund that amount.
4. Prices and payment
- Prices shown on this website are in Kenya Shillings (KSh). Where a fixed price is shown (for example pool maintenance per visit) that price applies; other services are quoted before the booking is confirmed.
- We accept payment by cash, M-Pesa or bank transfer. Unless agreed otherwise in writing, payment is due on the day of the service. Corporate events and recurring pool maintenance contracts may be invoiced as agreed with you.
- Pool treatment prices cover our labour and standard balancing chemicals for a normal visit. Major treatments (for example a green pool clean-up), replacement parts and specialist chemicals are quoted and charged separately, with your approval first.
- We may change our prices at any time, but the price confirmed for a booking will not change for that booking.
5. Your health and your responsibilities (massage, therapy, hydrotherapy and fitness)
- Our services are not a substitute for medical care. We do not diagnose illness or prescribe medication. If you have a medical condition, are pregnant, have had recent surgery or injury, or are unsure whether a treatment is suitable, consult your doctor before booking.
- Before your first massage, therapy, hydrotherapy or fitness session you must complete our New Client Form truthfully and completely, and tell us about any change in your health before each later session.
- You must tell your therapist immediately if you feel pain, dizziness, discomfort or anything unusual during a session. You can ask to adjust or stop a treatment at any time.
- You accept that treatments such as deep tissue massage, cupping, dry needling, TENS, infrared light and hydrotherapy can have side effects, as described in our Health & Safety Disclaimer.
- Results are not guaranteed. Everybody responds differently, and improvement may take several sessions together with the home exercises we recommend.
- Our therapists keep a professional, non-sexual relationship with clients at all times. Any inappropriate request or behaviour will end the session immediately, with full charge.
6. Clients under 18
- Massage, physical therapy, hydrotherapy and fitness sessions for anyone under 18 require written consent from a parent or legal guardian (given on the New Client Form), and a parent or guardian must be present throughout the session.
- Swimming lessons for children are booked by a parent or guardian, who accepts these Terms on the child's behalf.
7. Swimming lessons and water safety
- Swimming involves a risk of injury and drowning. Our coaches teach and supervise the children and adults in their lesson, but parents and guardians remain responsible for supervising their children at all times before and after the lesson, and for any children who are not in the lesson.
- You must tell us about any medical condition that may affect safety in water (for example epilepsy, asthma, heart conditions or ear problems).
- Swimmers must follow the coach's instructions. We may remove a swimmer from the water if it is not safe for them to continue.
- Learning to swim takes time, and we cannot guarantee that a swimmer will reach a particular level within a set number of lessons.
8. Lifeguard and event safety services
- Our lifeguards provide water-safety supervision for the area, time and number of swimmers agreed in your booking. They reduce risk but cannot eliminate it, and their presence does not replace the duty of parents, guardians and hosts to supervise children and guests.
- You (the host) are responsible for the safety of the venue, including the pool, its fences, gates, depth markings, water quality and equipment, and for telling us the expected number of guests and swimmers in advance.
- The lifeguard may close the pool or clear the water at any time if conditions are unsafe (for example overcrowding, poor water clarity, lightning, alcohol use or rough play). Their safety decisions must be followed.
- For hikes and outdoor water locations, natural water carries extra risks (currents, hidden rocks, depth changes, cold water). Participants enter natural water at their own risk and must follow the lifeguard's instructions.
9. Pool maintenance services
- You must give us safe access to the pool and its equipment on the agreed days, and tell us about any known faults, leaks or electrical problems.
- After chemical treatment, please follow our advice on when the pool can safely be used again, and keep children and pets away from the pool and from any chemicals while we are working.
- We are not responsible for existing defects, wear and tear, or the failure of old or faulty equipment (for example pumps, filters, pipes, heaters or tiles) that we did not install, or for problems caused by weather, heavy use, other contractors or a lack of agreed visits.
- Water balance changes between visits because of rain, sun, bathers and debris. We keep it balanced at each visit, but cannot guarantee water conditions between visits.
10. Limitation of liability
We take great care in everything we do. To the extent permitted by the laws of Kenya:
- we are not liable for any injury, loss or damage that results from information you did not give us or gave us incorrectly (including your health information), from your failure to follow our instructions or advice, or from the known and inherent risks of the services you chose, as described in our Health & Safety Disclaimer;
- we are not liable for indirect or consequential losses, such as loss of income, business or opportunity;
- where we are liable for loss or damage to property, our total liability in connection with a booking is limited to the amount you paid for that booking.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Kenyan law, including liability for death or personal injury caused by our negligence, or your rights as a consumer under the Consumer Protection Act.
11. Your responsibility to us
You agree to compensate us for any loss, damage or claim we suffer because you gave us false or incomplete information, broke these Terms, or (as a host or event organiser) failed to meet your responsibilities for the venue and your guests, except to the extent the loss was caused by our own negligence.
12. Photos and reviews
- We will not photograph or film you, or use your name or review publicly, without your permission.
- Photos of our team and services on this website are for illustration.
13. This website
- The information on this website is general information, not medical or professional advice for your situation. We try to keep it accurate and up to date but do not guarantee that it is complete or error-free.
- The text, logo, photos and design of this website belong to Hydrokinetic Therapy or are used with permission, and may not be copied for commercial use without our written consent.
- Links to other websites (for example WhatsApp or social media) are for convenience; we are not responsible for their content or how they handle your data.
14. Events outside our control
We are not responsible for delays or failure to provide a service caused by events outside our reasonable control, such as severe weather, flooding, power or water outages, road closures, illness, public health restrictions or civil unrest. We will reschedule or refund any advance payment for services we could not provide.
15. Complaints and disputes
If you are unhappy with any part of our service, please tell us as soon as possible by phone or WhatsApp on 0716368914 or by email at info@hydrokinetictherapy.com, so we can try to put it right. We will respond within 7 days. If a dispute cannot be resolved between us, both parties agree to first try mediation in Nairobi before going to court.
16. Governing law
These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have jurisdiction over any dispute.
17. Changes to these Terms
We may update these Terms from time to time. The version on this page when you book applies to that booking.
